1. Authorization
The client authorises Cromac Data Recovery or its agents to conduct an evaluation of the media sent to determine the nature of the damage and provide an estimate of the data recovery cost and turnaround. The evaluation is free and no work beyond this evaluation will be charged without explicit client approval. The client hereby represents, warrants, and affirms that he, she, or it is the owner or the authorized representative of the owner of the property and all of the information and data stored on said property. By asking Cromac Data Recovery to enter into this agreement with you, as client, you declare that the forgoing representations are true and correct.
2. Failure to claim property
Any property left with Cromac Data Recovery unclaimed for 30 days, will be disposed or recycled. At which time, Cromac Data Recovery shall have no liability to the client or any third party.
2.1 Cancellation
A client may request to cancel the service project at any point. If the customer has already approved service based on the quote provided by Cromac, a cancellation fee of the greater of either 25% of the quoted service fee will apply (Service Taxes Extra as applicable).
3. Limited Liability
Cromac Data Recovery shall not be liable as a result of this agreement or the performance of any data recovery services or evaluation of the possibility of providing data recovery services, for any claims regarding the physical functioning of equipment OR media or the condition or existence of data on storage media supplied before, during or after service.
THE CLIENT UNDERSTANDS THAT DATA RECOVERY CANNOT BE GUARANTEED, if the hard drive/media has been severely damaged, or in case of physical failure of storage media.
All data recovered will be kept for a period of 10 days after successful delivery to customer. Data will be destroyed and thereafter no further records will be kept.
3.1 Unrecoverable / Unsuccessful Recovery
If we are unable to recover any data, we will inform you accordingly and not charge you for our efforts. If, we are able to recover part but not all of your data, we will inform you accordingly and you may choose to receive the recovered data for the agreed fee.
3.2 True No Data, No Charge Guarantee
Unlike many of our competitors, our data recovery services come with a True No-Data, No-Charge Guarantee. There will be no service charge if we cannot recover your data — with no strings attached. The sole exception to this is if we are unable to recover your data due to encryption (other than hardware encryption put in place by the manufacturer): in that case, 20% of the data recovery service fee would be due.
At Cromac, we do not charge attempt fees, second-chance fees, or any of the other hidden fees for normal medias except Raid/Servers - Emergency Data Recovery Services that are so common at other data recovery service providers. We pride ourselves on being helpful and transparent, so the cost of your data recovery service is all-inclusive, and you don’t have to worry about small add-ons that can quickly drive up the cost of your service.
4.Confidentiality
Cromac Data Recovery agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client equipment except to employees or agents of Cromac Data Recovery India subject to confidentiality agreements or as required by law.
4.1 Providing your Donor Drives
If you provide your own Donor Drives for your Data Recovery Needs in any case if Data Recovery is not possible means, Cromac is not responsible for your Donor Drive and we are not paying any Donor Drive Charges, we will return your Donor Drives as default, you are giving your Donor Drives by your own risk.
5. Payment
Payment is due in full upon completion of Data recovery, prior to release of data (whether shipped, picked up or downloaded), unless by special previous arrangement.
Successful data recovery is defined as recovery of data that was not accessible or visible under the client's computer operating system.
The client agrees to pay for data recovery even if Cromac Data Recovery has partially recovered the data.
No data, no fee applies only when no data recovery is possible.
The client is financially responsible for all shipping costs, custom duties and taxes to and from Cromac India. We ONLY accept Cash, bank deposit, NEFT/RTGS.
The client must review the file list within five (5) days of the project being completed. If the client does not decline the file list within that five-day period, Cromac will consider the file list as approved and after completion project customer have 7-10 days of time to make payment to Cromac, if you are unable to process a payment, we will add a storage fee of INR 200 per day as STORAGE CHARGE of your Data. if your failed to pay after 30 days of job completion unclaimed for 30 days, will be disposed or recycled. At which time, Cromac Data Recovery shall have no liability to the client or any third party.
6. Warranty
Cromac Data Recovery makes no warranty, express or implied, and Cromac Data Recovery disclaims any warranty of any kind, for the services being provided or discussed hereunder.
